ESL Nearby is a product of ESL SKILLS LLC, a United States company. We operate in accordance with applicable United States laws, including export-control and economic-sanctions requirements. This page forms part of our Terms of Service.
1. What we offer
When ESL Nearby is available in your location, our services may include:
- The website — free and paid English courses, your account, and writing or speaking activities included with those courses.
- The iOS and Android apps — spoken lessons, quizzes, pronunciation practice, and conversational learning features.
- Related support — assistance with your account, purchases, billing questions, and use of our services.
Some features use third-party technology, including the OpenAI API. When you use certain AI-powered features, your writing, speech, transcription, or chat content may be transmitted to a service provider for processing. Additional information is provided in our Privacy Policy. Privacy Policy.
2. Where the service is available
We aim to make ESL Nearby available in countries and regions where we are legally and technically able to provide the service.
Availability may depend on United States law, export controls, economic sanctions, payment-provider requirements, app-store requirements, AI-service availability, and other third-party services that ESL Nearby relies on.
As a result, some courses, payment methods, AI-powered features, or applications may not be available in every country or region, even if the ESL Nearby website can be accessed there.
3. Restricted locations and persons
We do not knowingly provide services, process transactions, or make features available where doing so would violate applicable United States sanctions, export-control laws, or other applicable law.
We also do not knowingly transact with individuals or organizations that are blocked or otherwise prohibited under applicable United States sanctions, including persons appearing on applicable sanctions lists maintained by the U.S. Department of the Treasury’s Office of Foreign Assets Control (OFAC).
This restriction also applies to entities that are considered blocked under applicable OFAC rules, including entities owned, directly or indirectly, 50 percent or more in the aggregate by one or more blocked persons.
We may also restrict or discontinue service in a country or region when a payment provider, app store, artificial-intelligence provider, hosting provider, or another service provider that we rely on does not permit us to provide the relevant service there.
4. Your confirmation
By creating an account, purchasing a course, or using ESL Nearby, you represent that you are legally permitted to use the service and that your use of ESL Nearby does not violate applicable sanctions, export-control restrictions, or other applicable laws.
You may not use another person’s account, a VPN, location-masking technology, or any other method for the purpose of circumventing a geographic, legal, payment, or service-availability restriction imposed by ESL Nearby or one of our service providers.
5. If we cannot serve you
If we determine that we cannot legally or technically provide ESL Nearby to you, we may refuse a registration or transaction, restrict particular features, suspend access, cancel a purchase, or terminate an account where reasonably necessary.
Any refund will be handled in accordance with our Return Policy, applicable law, and the rules of the payment provider or app store through which the transaction was made. Return Policy.
Nothing in this section requires ESL Nearby to process a payment, refund, transfer, or other transaction when doing so would violate applicable law.
6. Travel and location changes
Service availability may change when you travel to or reside in another country or region.
Using a VPN, proxy, or similar technology does not change the legal or geographic restrictions that may apply to your use of ESL Nearby.
You are responsible for ensuring that your use of ESL Nearby is permitted under the laws applicable to you.
7. Changes to availability
Laws, sanctions programs, technology providers, payment networks, and app-store requirements can change.
We may therefore change the countries, regions, features, or payment methods in which ESL Nearby is available.
When we make material changes to these terms, we may update this page and its effective date and provide additional notice where required by applicable law.
